Terms of Service

These Terms of Service (“Terms”) govern your use of the North Idaho Towing website, dispatch line, AI answering system, and tow/roadside services (collectively, the “Services”). By using the Services you agree to these Terms.

1. Services

We provide towing, jump starts, lockouts, tire changes, fuel delivery, and other roadside assistance in and around Sandpoint and Bonner County, Idaho. Service availability depends on location, weather, vehicle accessibility, driver availability, and safety conditions. ETAs are estimates and not guarantees.

2. SMS Messaging Terms

You consent to receive transactional SMS messages from us related to your service request, including driver assignment, ETA, arrival, payment links, and follow-up. Message frequency varies. Message and data rates may apply.

• Reply START to opt in to operational SMS messages from North Idaho Towing.
• Reply STOP (or UNSUBSCRIBE, CANCEL, END, QUIT) at any time to opt out. You will receive one confirmation message and no further SMS.
• Reply HELP at any time for assistance and contact information.

3. Pricing and Payment

• Estimates are quoted before dispatch when possible. Final price may change based on distance, time, equipment, mileage, storage, or unanticipated difficulty.
• Payment is due upon completion of service. We accept card payments through secure hosted payment links. We do not collect card numbers by phone or store them.
• You authorize us (or our payment processor) to charge the payment method you provide for services rendered and any related fees.

4. Customer Responsibilities

• Provide accurate location, vehicle, and contact information, and remain reachable.
• Be present at the vehicle (or authorize a representative) when the driver arrives.
• Disclose vehicle modifications, low clearance, all-wheel drive, EV/hybrid status, or other conditions that affect towing safely.
• Confirm you have authority to request service for the vehicle (ownership, lease, or permission).

5. Cancellations and No-Shows

You may cancel before a driver is dispatched at no charge. After dispatch, a service fee may apply based on driver time and distance. If we cannot reach you or you are not present at the vehicle within a reasonable time after arrival, a no-show fee may apply.

6. Call Recording & AI Answering

Calls to our dispatch line may be answered by a human or AI system and may be recorded for quality, safety, and dispatch accuracy, consistent with Idaho’s one-party consent law. By continuing the call after disclosure, you consent to recording.

7. Disclaimers

SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE WEBSITE OR MESSAGING SERVICE.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NORTH IDAHO TOWING AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS, ARISING FROM OR RELATED TO THE SERVICES. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM A SERVICE CALL IS LIMITED TO THE AMOUNT YOU PAID FOR THAT SERVICE CALL. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW (INCLUDING GROSS NEGLIGENCE OR WILLFUL MISCONDUCT).

9. Damage Claims

Any claim for damage allegedly caused during service must be reported in writing within 48 hours of completion, with photos and a description, to dispatch@northidahotow.com. Failure to provide timely notice may limit our ability to investigate and respond.

10. Indemnification

You agree to indemnify and hold North Idaho Towing harmless from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your inaccurate information, unauthorized service requests, or violation of these Terms or applicable law.

11. Governing Law & Disputes

These Terms are governed by the laws of the State of Idaho, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Bonner County, Idaho, and you consent to personal jurisdiction there.

12. Changes

We may update these Terms from time to time. Continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
